Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Heduly. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use Heduly.

1. Who can use Heduly

You must be at least 18 years old and a parent or legal guardian. You are solely responsible for your family’s use of the service, including any use by your children through the kid view.

2. What Heduly is (and is not)

Heduly is a parent-controlled planning and organization tool that helps families design a homeschool week matched to their chosen educational philosophy. Our AI generates suggested plans and activities. You review and approve everything before your children see it.

Heduly is not:

• A school, online school, or educational institution
• An accredited program
• A provider of instruction
• Legal or compliance advice

You remain solely responsible for meeting all applicable state homeschooling laws and requirements. Our compliance features (hours log, observation journal, portfolio export) are record-keeping aids only. They do not guarantee compliance. Requirements vary by state and can change.

3. AI-generated content

Plans and suggestions are generated by artificial intelligence and may contain errors, inaccuracies, or unsuitable recommendations. They are proposals only. You are solely responsible for reviewing, approving, and determining the safety, age-appropriateness, and suitability of any activity before your child engages with it. Heduly does not guarantee any educational outcome.

4. Tutor marketplace

Heduly may offer a marketplace that allows parents to find and book independent tutors.

• Tutors are independent third parties, not employees, agents, or contractors of Heduly.
• Heduly does not employ, supervise, or control tutors.
• Heduly does not guarantee the quality, safety, qualifications, or performance of any tutor.
• Any agreement for tutoring services is solely between you and the tutor.
• You are responsible for evaluating tutors, verifying credentials or background checks if desired, and supervising sessions.
• Heduly may charge a platform fee or commission on bookings. Specific fees will be disclosed at the time of booking.
• Heduly is not liable for any claims arising from tutoring sessions, including injury, inadequate instruction, or disputes between parents and tutors.

5. Your account

Keep your login credentials secure and your information accurate. You are responsible for all activity under your account. Notify us immediately at learn@heduly.com if you suspect unauthorized use.

6. Your content

You own the content you submit (including your children’s information, journal notes, photos, and progress data). You grant Heduly a limited, non-exclusive license to store, process, and display that content solely to provide the service to you, including sending limited context to our AI providers as described in our Privacy Policy.

You are responsible for ensuring you have the right to upload any content and that it does not violate any law or third-party rights.

7. Subscriptions and billing

Heduly currently offers a Free plan and a paid Family plan. Pricing is displayed on the website and may change from time to time.

• Paid subscriptions are billed through Stripe and renew automatically until canceled.
• You may cancel at any time via the billing portal. Cancellation takes effect at the end of the current billing period.
• Fees are in U.S. dollars. Except where required by law, payments are non-refundable, though we may issue refunds at our sole discretion.
• We may introduce additional plans or change prices with reasonable advance notice. Price changes apply to future billing periods only.

8. Acceptable use

You agree not to:

• Use Heduly for any unlawful purpose
• Attempt to access another family’s data or breach security
• Reverse engineer, scrape, or resell the service
• Upload content that is unlawful, harmful, infringing, or inappropriate
• Use the service in any way that could harm children or other users

9. Availability

We strive to keep Heduly reliable, but we provide it “as is.” We may modify, suspend, or discontinue features at any time. Keep your own copies of important records.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms or applicable law.

11. Disclaimers

To the maximum extent permitted by law, Heduly is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Heduly and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising out of or relating to these Terms or the service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) One Hundred U.S. Dollars (US $100).

13. Indemnification

You agree to indemnify, defend, and hold harmless Heduly and its operators from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the service, your content, your violation of these Terms, or your interactions with tutors.

14. Dispute resolution: arbitration and class action waiver

Any dispute arising out of or relating to these Terms or the service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Heduly waive any right to a jury trial and any right to participate in a class action or class-wide arbitration. This section does not prevent either party from seeking injunctive or other equitable relief in court for intellectual property or data protection matters.

15. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to the arbitration provision above, exclusive venue shall be in the state or federal courts located in Florida.

16. Changes to these Terms

We may update these Terms from time to time. We will post the revised version with a new “Last updated” date. For material changes, we will provide additional notice. Continued use of Heduly after the effective date constitutes acceptance of the updated Terms.
